1. These terms

1.1 These terms apply to every order you place with us through crosslinkstrade.com.au, by email, or by telephone. By placing an order you accept them.

1.2 We may update these terms at any time. The version published when you place your order is the version that applies to that order.

1.3 Our Returns and Cancellations Policy, Shipping Policy and Privacy Policy form part of these terms.

2. Orders

2.1 Product listings on our website are an invitation to buy, not an offer. Your order is an offer to purchase from us.

2.2 A contract is formed when we confirm your order in writing or dispatch the goods, whichever happens first.

2.3 We may decline any order, including where stock is unavailable, where a price or description error has occurred, or where we are unable to verify payment. If we decline an order you have already paid for, we will refund you in full.

2.4 Written quotations are valid for 30 days unless the quotation states otherwise.

3. Prices and payment

3.1 Prices shown on our website are in Australian dollars and include GST. Delivery charges are additional and are calculated at checkout or quoted separately. The total payable is shown before you confirm your order.

3.2 We issue a tax invoice for every order, showing the GST included in the price.

3.3 Where we quote a price as excluding GST, we will say so expressly in the quotation.

3.4 Payment in full is required before dispatch, unless we have approved a credit account for you in writing.

3.5 We may change prices at any time, but not after we have accepted your order.

4. Goods cut or made to your order

4.1 Fabric, webbing, binding tape, rope, shockcord, hook and loop, and similar goods sold by the metre are cut to the length you specify. These are made to your order.

4.2 Cut lengths are supplied within normal industry tolerance. Minor variation in length, shade and batch is inherent to textile production and is not a defect.

4.3 Once cutting has commenced, cut goods cannot be cancelled, returned or exchanged, except where you have a right to a remedy under clause 8. This applies regardless of order value.

4.4 If you are unsure whether a product suits your application, ask us before ordering. We will supply a sample or swatch on request.

5. Cancelling an order

5.1 To cancel, email sales@crosslinkstrade.com.au before your order is dispatched. A cancellation takes effect only when we confirm it in writing.

5.2 Where we accept a cancellation, the following applies:

Before the order has been picked. We refund the order in full, less the payment processing costs our payment provider charges us and does not return when a refund is issued. These are currently 1.6% of the order value plus $0.30 for domestic Australian cards, and up to 3.5% plus $0.30 for international cards and some digital wallets.

After the order has been picked or packed, before dispatch. The above, plus a handling fee of $15.00 covering the labour to unpack the order and return the goods to stock.

Goods cut or made to your order. Clause 4.3 applies. These cannot be cancelled once cutting has commenced.

After dispatch. The order can no longer be cancelled. Any return is dealt with under our Returns and Cancellations Policy, and freight in both directions is not refundable.

5.3 These amounts recover costs we have actually incurred. They are not a penalty, and we do not profit from them.

5.4 Nothing in this clause limits your rights under clause 8.

6. Delivery, risk and title

6.1 Delivery times are estimates. We are not liable for delays caused by carriers or by events outside our control.

6.2 Where you buy as a business and nominate your own carrier, risk in the goods passes to you when the carrier collects them. In every other case the goods remain at our risk until they are delivered to you.

6.3 Title in the goods passes to you when we receive payment in full.

6.4 Please inspect your delivery on arrival. Tell us within seven days if anything is short, damaged in transit, or incorrectly supplied, so that we can lodge a carrier claim in time.

7. Returns

7.1 We do not accept returns for change of mind. Please confirm that a product suits your requirements before you order.

7.2 If a product is faulty, damaged, or not what you ordered, contact us and we will assess it and provide a remedy under clause 8.

7.3 Where we agree, as a goodwill gesture, to accept a return we are not required to accept, the goods must be unused, in original packaging and in resaleable condition.

A restocking fee of 20% applies, and freight in both directions is not refundable.

7.4 Do not send goods back before we have issued a return authorisation. Unauthorised returns will not be accepted.

8. Your rights under the Australian Consumer Law

8.1 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

8.2 The following statement applies to our goods:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8.3 Where the goods are not of a kind ordinarily acquired for personal, domestic or household use, and to the extent the law permits, our liability for failing to comply with a consumer guarantee is limited to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so. We choose which of these applies.

9. Warranty against defects — machinery

9.1 We give the following warranty on cutting machines, shears, spreading, inspection, ironing and embroidery equipment, and similar machinery. It is given by Cross Links International Pty Ltd, ABN 53 054 163 003, Unit 6, 18–22 Williams Road, Dandenong South VIC 3175, sales@crosslinkstrade.com.au, 0414 602 770.

9.2The warranty period is two years from the date of delivery, unless the product page states a different period.

9.3 If the machine develops a defect in materials or workmanship within the warranty period, we will repair it, replace it, or refund the price you paid. We decide which of these applies, and we bear the cost of the repair or replacement itself.

9.4 To claim, contact us at the details above with your proof of purchase and a description of the fault before sending anything back. We will tell you where to send the machine and issue a return authorisation.

9.5 You bear the expense of claiming under this warranty, including freight to us and any labour to remove the machine from service or reinstall it. Where we accept the claim, we pay the cost of returning the machine to you.

9.6 This warranty does not cover consumable and wear items, including blades, sharpening stones, belts, brushes and bearings. It does not cover damage caused by misuse, accident, inadequate maintenance or lubrication, incorrect power supply, unauthorised repair or modification, or use outside the manufacturer's stated specification.

9.7 The benefits given to you by this warranty are in addition to other rights and remedies you have under a law in relation to the goods to which the warranty relates. In particular, your rights under clause 8 are not limited by this warranty, and the consumer guarantees may continue to apply after the two year warranty period has ended.

9.8 The statement in clause 8.2 applies to this warranty.

10. Product information

10.1 We take care to describe our products accurately, but specifications, weights and compositions are supplied to us by manufacturers and may change.

10.2 Colours shown on screen are indicative only. Order a sample if colour matching matters.

10.3 You are responsible for deciding whether a product is fit for your intended use. Where we give advice, it is general unless you have given us your full requirements in writing and we have confirmed suitability in writing.

11. Our liability

11.1 This clause is subject to clause 8 and applies only to the extent the law permits.

11.2 We are not liable for indirect or consequential loss, including loss of profit, loss of contract, or production downtime.

11.3 Our total liability arising from any order is limited to the amount you paid for that order.

12. Using our website

12.1 The content of this website, including text, images, product photography and logos, belongs to us or our suppliers. You may not copy, republish or use it commercially without our written permission. This includes extracting product listings, descriptions or prices by any automated means.

12.2 If you hold an account with us, you are responsible for keeping your login details secure and for activity that occurs under your account.

12.3 You consent to us communicating with you electronically. Notices we send by email satisfy any requirement that they be in writing.

13. Privacy

13.1 We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

14. Governing law

14.1 These terms are governed by the laws of Victoria, Australia.

14.2 You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.

15. General

15.1 If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.

15.2 If we do not enforce a right immediately, that does not mean we have given it up.

15.3 These terms, together with the policies referred to in clause 1.3 and any written quotation, are the entire agreement between us.
